Co-Employee Liability Workplace Injuries

Although co-employees are generally immune from suits in state court for injuries that happen at work, they can be sued directly if their conduct was reckless or if it required the injured employee to perform an act outside his normal work duties.

In this situation, the injured employee would generally make a claim for workers' compensation and then he or she would bring a suit against the co-employee or supervisor who required the employee to perform the dangerous task, causing the injury.
